Can a health care facility move a patient with dementia who falls out of bed, needs help to eat, cannot walk from their facility without the Power of Attorney’s consent?

Medicare will only pay for skilled care. Bathing, feeding and assistance with ambulation can be done by a non-skilled person. Skilled usually means licensed. Although a nurses aid has certificates the care they provide is not considered skilled by Medicare standards. The standard is not whether someone is sick but whether the care required is skilled care. The nursing home does not have to keep him but if Medicare does not pay you may have to pay privately. There will still be a bill. If they take Medical you may have a share of cost and have to turn over the majority of his social security. They cannot dictate where you take him but they can expect to be reimbursed from his funds or estate for care not paid for by Medicare or Medical.

What kind of Health Care facility is he in now? Skilled Nursing?
They want/need to move him because his money is running out and they are not willing to accept Medicaid. Is that correct?
And you think he needs a Nursing Home, and they think he needs Assisted Living?

If he can't pay his bills, I guess they have the right to evict him. I wouldn't think that they can dictate where you take him. But I don't know. Please clarify the situation so someone with similar experiences can give you a more informed answer.

Hmm ... if they are being paid by Medicare, does that mean they are a transitional care unit, maybe doing rehab? How long as he been there? Just a few more details will help.
