I have medical power of attorney and my mother has dementia. What would I need for legal guardianship?

Before you take that step, you should read the GAO's scathing 2010 report: Guardianships, Cases of Financial Exploitation, Neglect and Abuse of Seniors.


Don't make the mistake of thinking guardianships "guard" incompetent people, "protect", protect them, or "conserve" their estate. Unlawful and abusive guardianships are a growing national crisis pauperizing vulnerable people under the deception of "protection."

Guardianship is designed to be a matter of last resort. Consider not going there unless there is no other option.
