My mom is in a nursing home and she has full blown dementia. She has also recently had a bout with pneumonia and had stopped eating, A few months ago she had a urinary tract infection. When she stopped eating the nursing home sent her to a hospital where the equipped her with a feeding tube. She also is no longer able to communicate verbally with anyone. It seems she just keeps getting sick and sicker all the time. My issue is this She has no money left, the nursing home has taken it all for her care. I have no money because i am on a fixed income. If she were to pass away how am I supposed to bury her or pay for her funeral expenses? That's why I need to know if i can legally buy the insurance for her even tho she can't give me permission verbally to do it.

I imagine (but don't know) that you could legally buy the insurance, but I really doubt that any company would give you a policy on her. She is clearly close to death, so they know that they'd have to pay out.
Talk with the Medicaid people about burial. They have seen this situation before.

You might want to start looking into cremation services as they are much cheaper.
