How can I get the bank to give me money from my deceased parents accounts?

My brother and I were left as the beneficiaries of a Living Trust and would like to get the $$ that is in the account. Bank of America had us send in an affidavit, but sent me a letter saying that it was completed incorrectly, but will not tell me why. There was no executor established, but we are shown as the benefactors. What can I do? My parents passed away on 9/25/2012 and on 10/30/2012.... did not have time to send info to the banks at the time of their deaths :(

Call an attorney. Remember, BOFA makes money on interest (and uses deposits for lending) so it is in their best interest to make it as difficult as possible for someone like you to withdraw money.

Another option: call the bank manager or legal department and request from them exactly what is needed. Then if you still can't get an answer, go to social media.

Regarding Bank of America, my dad banked there and I needed his statements when I applied for Medicaid. I took my POA to Bank of America and they made me wait for an hour while they all decided on whether to honor the POA. Finally the gal came back to the office where I was and said that they'd honor it JUST THIS ONE TIME and I could only ask for statements THIS ONE TIME. They also gave me 10 miles of bad road about it, made me feel like they were doing me a favor, and I slunk out of there feeling as if I'd done something wrong.

Can't you call BOA and speak to a rep to ask specifically what you need to do to meet their requirements? Have you tried talking to someone there? Was there a name on the bank letter? Start with that person.

Marg - are you both legal residents of the state? & do you know if everything - & I mean everything that could be considered an asset - was put into the trust? How do the letters from BoA read?
