What do you do with a 23 year old young man who has been grossly stealing from his parents?

What do you do when you want a twenty three year old son out of the home who has been grossly stealing from his mom ( more so) and his dad. And his mom is in denial and accusing the dad of the thievery. The Father addressing the stealing has been threaten three times. He has taken the matter to the family court in the bronx and there has been delay after delay in getting a hearing from a judge. The lawyer for the father has been disappointing in action and in counsel. The mother has been damaged emotionally because some great valuables have been stolen from her and the father is suffering the consequence of the son stilling from the home and being accused of it by the mother, the father's wife.The son has been using drugs but seem to have made some changes in the use of drugs due to some behavior change; but the stealing has continued. The father has wondered if a mental evaulation of the son would be helpful if it was possible for that to happen.. What can be done in this situation.
