Can a parent that has dementia sign legal documents about real estate that they own and give it to a family member?

My mother passed away a week ago and I just found out that my sister had the house my mom own signed over to her when my mom had full onset of dementia this was done four mos before she passed also had a power of atty done on the same day this is not my moms hand writeing and how could this been done when my mom could even understand what was going on or who anyone was how could a lawyer do this and not notices that my mom was not in her right mind at the time of these papers been drawn up please please help me thank you

It is deplorable how greed can tear a family apart but it happens all the time and is more common than the family that is unaffected by money….my uncle tried to rip off my mother, his sister, of course his wife was the driving force there….Human greed has to be a sin…"Thou shalt not covet what is more than your fair share."

You will most likely need to retain an attorney. What sister did is a crime, undue influence. Dealing with similar situation here, but mom is still alive. Sib had mom sign over control of all her accounts and is now in big trouble. Could lose her job and the nice retirement that goes with it. Serves her right.

Check out website AVVO to find an attorney. The site allows you to post questions, you will receive responses at no charge. Make sure the attorney has a good part of the practice as litigation sounds like it could very easily come to that.
