Who is liable?

I am/was POA for my mother. The advisor accepted beneficiary designations (my sister and myself) for her RRIF. Now that she has passed, they said that POA cannot designate beneficiaries. What do I do as I had no idea that it was not a legal process. Now the bank wants probate done

Thanks for your response. I am checking with a lawyer in both Sask and Man. Live and learn but a heads up to those who believe in the knowledge of their financial institution.

Also check your provincial probate laws. Here in the US it would be illegal for a POA to designate themselves, it would be a "conflict of interest"

Actually, it is too late to change beneficiaries on a Registered Retirement Income Fund (RRIF in Canada) if the account holder has died. Whatever she designated previously is what holds. Hopefully you can find her Will. Your duties as POA ended the moment she died. Now the Executor of the Will takes over. Find the Will!!
