Can my grandfather spend his money down on needed home repairs without fear of Medicaid considering it a spend down as gifts?
My grandfather put his home into my parents name 20 years ago, but still pays for maintenance, home upkeep, etc. on the home. to my parents, thus extending the period in which he must wait for Medicaid benefits?
If the home does not belong to your grandfather, but he is paying for this asset that belongs to someone else (your parents), Medicaid will treat this money spent as gifts/transfers of assets. They would be better off setting up a caregiver agreement for services that they use to pay for such things. Please consult an elder law attorney familiar with Medicaid in your state - it will save you grief later.
