Legally, can I take my Mother from the facility?

The guardian has a legal duty to the Ward (person she is guardian of). I would contact an attorney as well. The court may step in for good cause and remove or appoint another guardian. They can act quickly if it's an emergency.

Immediately contact your county APS (adult protective service). They can haul the Guardian into court.

In a case where the Guardian isn't responding to their parent's care, I would contact an elder law Attorney to see what would be the next step.
