My wife's mom had dementia had to have night care. she stay with her mom at her moms home 16 hr. a day for 329 day without pay. her mom past away past nov. dose she deserve to be payed for being her moms caregiver by law. no one would help look after their mom but my wife and I . we loved her very much and did not want money to upset any one.

In fact, majority of grown children are not paid for being a caregiver unless the parent can pay from their own retirement fund. If your wife's mother was able to do this, your wife would have needed to have put together an employment agreement, but that cannot be done after the fact.
