Does financial power of attorney have the right not to pay a home health bill?

Ariemarie, it sounds like the medical side is recommending a nursing home and the financial POA agrees. If that is correct, don't fight it. As an RN you have heard lots of patients want to go home before they should. What happens? They end up back in the ER in no time at all.

This can be one of the problems of splitting the financial and legal responsibilities.

Addressing only the issue of your brother's disagreement with paying a home health care bill, if your father is still cognizant and can make his own decisions, why would your brother even be responsible for paying the bill? Your father can make the decision to pay the home health care bill and handle it himself, or create a checking account jointly with you so that you can pay the bill.

Thanks for your response. However my dad went for rehab and he needs an additional 4 hrs of care a day outside of what his benefits and family is going to do. I'm a registered nurse as well.

Don't do it. Nobody goes to a nursing home who only needs a few hours a day of care. They go because they are no longer able to care for themselves. On intake the patient is assessed and a care plan is established.
