I noticed that 50% or more of the care givers have no agreement or contract. Legally there is a presumption of gratuity for family caregivers unless the care rises to the level that no reasonable person would to go uncompensated. There are implied contract or oral contracts that allegedly are enforceable, whether you could enforce one without having at least $10,000 to start is another thing. Even a signed contract is not a sure thing if a lawyer has not reviewed it to insure its kosher and a Dr will reinforce the family caregivers position, but be ready to fight for it. DO not trust a simple agreement, there are too many ways to be sued for it, for example if you had performed the same tasks for free before , there is an argument that is was gratuitous in total. Its all a lot of luck good or bad otherwise. payable on death accounts and financial POA or expect to be pushing a shopping cart around town.
