Can a power of attorney be drawn up when parents are incompetent?

My husband takes care of his parent he shares poa with his brother after mom died now he is questioning every dime spent and want receipts for everything he never question before but now mom is not here my husband stop working to take care of them and my brother in law wanted them in a nursing home he is threating my husband now it is getting crazy.
