One is called a Fiduciary income tax return and the other is a personal income tax return if their income is a certain amount or there might be a tax refund. Get a lawyer. This is way too complicated for you and there are no simple answers. Wait 'til you get to the part about what order the bills are paid in and how long the waiting period is. I'm sure you know nothing about EIN numbers and establishing estate accounts, filing the 2015 and 2016 tax returns, both state and federal, for the person and for the estate.
