BlindFaith Asked May 2016

Sister-in-law has just been granted guardianship of her mom in nursing home. What is guardianship pay?

Her moms money will be gone fast. Sis wants to put aside $ for mom's possible legal fees. Please advise.

pamstegma, thanks for helping us understand. Sis wants no compensation by choice. As far as lawyer fee bills after Medicad I guess we'll cross that bridge when/if it happens.

Read the court order very carefully. If the Guardian wants pay, they put that in the petition and their annual report and the judges approves or denies it. It's an hourly rate based on time spent on paperwork and visiting the client. Your state has Guardianship training. Get trained asap. I am a Guardian in NY and do not take any compensation by choice.

vstefans, Sis wants nothing for herself, but heard of guardian pay that may be a way to have legal fee money available before Medicaid.

I am a professional guardian and states vary in terms of whether and how much a guardian can be paid. I agree with above that the letters of guardianship should indicate whether payment is involved. The other option is to check with the attorney that drafted the documents.

It is quite probably appropriate. Things that can be set aside for certain things such as burial funds are non-counted assets if she is ever going to need Medicaid. It is possible to pay yourself a small and reasonable amount for the management things you do, and it should be spelled out in legal documents. Do you have reason to suspect she is doing anything incorrectly?
