Sibling is unwilling to move mother to a memory care center that takes Medicaid?

Sibling is unwilling to move mother to a memory care center that takes Medicaid. my mother is in a memory care facility since the first of may. She was moved to a secure room the end of June that is more expensive (by $1000 monthly). The facility does not take Medicaid, self pay. My sibling is not willing to move my mother to a facility that does take Medicaid; therefore, leaving the balance of the monthly bill up to us to pay. By law do we have to pay? We do not have a say in where she is.

K - just a thought BUT could your sister have a reason as to why she is insistent that mom not apply for Medicaid? Could there be any commingling of mom/Sissy's assets, income or transfers that could pose an inquiry or penalty by medicaid?

The POA is responsible for managing the principal's funds ... not the funds of the other relatives. The POA must figure out how to meet the person's needs within the person's resources.

POA cannot obligate other people to care for or provide finances for the person they are POA for.

Don't sign anything that will obligate you in ways you do not wish to be obligated.

There is a very good thread here from the past few days titled "sharing elder care with siblings, do not demand it..." I am going to bump it up for you, I think you'll find it helpful. One of the good points in it says, if one child is a hold out - not agreeing to a care plan that is workable for all involved, they then should not expect their sibling to dance to that tune - they get to shoulder the results of their decision. Take a look.

So, are mom's funds (pension, ss) being used to pay for the facility, or are you all chipping in to pay the bills now? Is mom eligible for Medicaid? Please give us a bit more information.

Kirch, if sis will not move mom to a Medicaid facility mom may have bigger problems. Many Medicaid facilities require a period of self pay before they will accept the Medicaid application. Some facilities without Medicaid will work with the family to lower fees if the resident has been there awhile. Some facilities will assist with finding a Medicaid bed. Some states have statutes that financial responsibility falls to children, but most states do not.
