I have POA for both parents with advanced Alzheimer's.
My parents both have advanced Alzheimer's. I am listed after each of them as POA. Now some of the companies I have been dealing with say I need something stating that I am the POA because they as re no longer able. What is my next step?
I think you are saying that each of your parents is the first POA for each other, and that you are next in line as POA if the first person is unable to serve. So, what you need is verification that the first POA is unable, most likely a written statement from one or two doctors that the person is unable to perform that duty. That is what is likely to be when you as the secondary POA steps up. It depends of course. If you need help in getting this done get a lawyer to walk you through this.
Mimi, if you are listed as a Power of Attorney you should have your own copy of this legal document due to the fact that you also had to sign this document saying you would accept this position.
If you do not have a copy of the POA, then it is time to search around your parents home to see if they have a copy or the original. Hopefully you can find it. I recently had to use the original in order to sell my parents house.
If you find the document, make copies. You'd be surprised how many places want to see the document. Most will scan it and give you the copy back.
You need to present the POA documentation (a legal piece of paperwork that was created when you were given POA by your parents which has their signatures and is notarized) to prove that you are POA.
