My 91 year old father is in assisted living with mild dementia. I am POA. My disabled brother cannot make ends meet and my father wants to gift him money to get by. Can money be given to the disabled son without penalty and is there an approved process to do this?

Meanwhile a couple of questions: is your brother actually your father's dependant? Or, failing that, has your father been in the habit of supporting or financially helping out your brother? I wonder if this might make a difference to Medicaid's view of gifts made to him.
