holdon, is there a reason you are not happy with the present conservator? Becoming a conservator is an expensive process that is done through the probate court. It can cost $5-10K at times, so isn't something you want to do on a whim. If the present conservator is not acting in good faith or is negligent, you can petition the court for reassignment. It he/she is doing a good enough job, I would leave it alone.
You need to enter the petition for guardian in the county court where she resides. She will be interviewed by a court evaluator to determine how confused she is and whether or not she agrees to you as a guardian. Your siblings will also be served notice of the show cause hearing. The Guardian should live within the jurisdiction of the court. They are subjected to fingerprinting, background check and credit check. They like to see stable employment and residency.
My mother is 81 years old and has moderate dementia. I would like to seek legal conservatorship of her as she is unable to make competent decision regarding her personal and financial welfare. Does anyone have any suggestions or even insights, on how to begin this process. I live in Northern California and need some guidance please....
