Does this person have the tendancy to go off their bi polar meds and then end up in the hospital? It's not unusual for mentally ill people to do that and if they have POA over someone, it has the potential to be really bad news. I would talk to APS and an elder care attorney.

Our parents deliberately chose as DPOA the middle son. Our oldest brother (now deceased) was dxed with so many mental disorders he was a walking textbook on them. Never medicated, never "OK". Younger brother is the calmest, most "with it" guy I know. He handles whatever comes along with peace and never lets anything get under his skin. There's 5 of us surviving kids, he handles the stuff mother needs and unless I flat out ask him how things are (financially or medically) with her, he never says anything. Mr. "no drama". It's great. I know quite a few people who are bipolar. On meds, they are usually fine and function well. Off meds, it's another story. POA's can be reassigned at the will of the person. If they are not able to make the "call" due to their own aging and mental capacity, I'm sure that a dr's "testimony" to the fact and a lawyer's touch would make things move along. If you feel your loved one is being taken advantage of by this person with POA, stand up and say something. Until you actually change the POA status, that's about all you can do.
Concerned4mom, if the person who has the DPOA is mentally ill and currently unable to perform these duties you should probably have it revoked. Is your mom able to do this? Does she have dementia or some other condition that renders her unable to revoke it? If so, you should contact an elder law attorney for advice and help in this matter. Many mental health issues can be treated (the same as physical issues) with the proper medication, but of course you need to take the medication. Have you talked with your mom about your concerns? Or is she unable to help in this regard? I think if you gave us all more information about the situation you may get more helpful answers to your question. Blessings, Lindaz.
The person you described, in my opinion, had far more mental health problems than just bipolar which contributed to the bad behavior. People with bipolar disorder either become manic which can reach the extreme of psychotic in which they think that have super ability or depressed in either a rapidly cycling mode or slower mode. From my reading about bipolar disorder, I have not seen anything about being mean as a symptom. Your comments only add the stigma that society has about people with a mental illness. We are far more likely to be the victim of violence than commit violence.
To the poster who said it's air responsible mentioned irresponsibility, maybe they should have a scary dilemma of their own, obviously they never have and are just downright evil toward those who have had a scary dilemma and have reason to be very scared of certain types of people. There are some types of people who should never ever ever ever ever be in any kind of position over others, and my very scary story is only one reason why because it almost ended in disaster and it did end in disaster for some other poor soul at the same hands, which is why I will never trust anyone with this type of disorder, and I'm sure the rape victim who got pregnant by this same man doesn't trust them either, and no doubt she may still have trust issues with anyone to this day. You don't know how bad it can get with these people unless you yourself have faced some sort of very scary dilemma, and I don't blame anyone who has trust issues with a type of person who hurt them.

If the bipolar is untreated, the person can become dangerous to anyone around them, so yes, you can have the POA revoked. You may have to see an eldercare lawyer for this or you can just talk directly to the patient to see what they want to do and warn them of what's coming. If the patient agrees to a change in POA, then the patient can authorize changes as long as they're competent. If for some reason your face resistance, definitely call an eldercare lawyer, APS, and if necessary, the cops.

If they go off their meds and it leaves their system to the point they no longer have a therapeutic level in their blood, look out and run because everyone's in danger. Furthermore, the person I knew would watch sci-fi and come up with some screwy ideas and it took quite a while to finally start connecting the dots. I finally started realizing the person was getting some screwy ideas from sci-fi shows he was watching and he was picking and choosing what he wanted to use for some screwy idea he was brewing in his mind. I don't know if this is part of the bipolar or if he was just downright sick, but by time I realized what was really going on and connected all the dots, it was God who intervened in the background to remove him from my life. Some of his sick ideas involve him taking advantage of me but fortunately he didn't have a chance to rape me but he did grope me in the name of the Lord through "thus sayeth the Lord", making me think God was really speaking through him when come to find out he really wasn't and I started questioning everything. It wasn't long until I got a few angelic visits between middle of the night and early morning. At some point I was given instructions on the last visit and things later started unfolding. The person made a final visit to my house after God put me into a very deep sleep but at the time it had to be in my enclosed bed so he couldn't have touched my head he come in to where I was sleeping. This was the only safe place in my home where I was untouchable, anywhere else he would've raped me. The reason I know it's because someone else who knew him knew of what happened when this person was done with some other poor girl, he targeted, he raped her and I was very close to that. Fortunately he didn't get that far though he had a key and made entry into my home looking for me while I was asleep because a very trusted friend came by and noticed my door was open when normally I kept it shut. God didn't bring me out of sleep until that trusted friend arrived and we got to talking about stuff. Yes, I knew the person had bipolar but I don't know if the bipolar is tied to all the screwy ideas he came up with through the sci-fi shows he was watching on TV. At first I thought nothing of it until I started noticing stuff from the shows coming up in some of his very clever speech. I then started praying to God to please never let this person ever touch another woman the rest of his life. Be very wary of the persons condition if they're either untreated or go off their meds, you never know what they can do until it happens. I hope my story helps someone out there, I've dealt with a bipolar person, and you just don't know what they are capable of until it happens. I'm hoping the justice system starts digging deep into peoples minds and find out more reasons behind more crimes because so many people out there are mentally ill and need to be locked up in a mental hospital and not a prison or jail
If you are the one issuing the POA for yourself, it's normally as simple as contacting your lawyer to draw up a new document, and ripping up the old one and telling your former POA you have assigned a new one. If the person who wants to reassign the POA is competent, they can do that too. It's up to the attorney to determine if the person is competent to assign POA, which is a legal not medical question.
I concur with the previous posts - revoking power as POA either comes from the person who holds it, or you will need to seek medical and legal counsel to have it done without their consent. Very challenging situation. May you be encouraged that you are working for their well-being, even when they resist or reject all that you are doing for the person who needs your help.
I have POA for my Mom. I checked with medical personnel a couple years ago when she had a bad upper respiratory infection and wouldn't go to the doctor. He said as long as she is of sound mind and hasn't been diagnosed otherwise there is nothing I can do. She has dementia, short term memory gone, seeing people in the house, hiding all her stuff cause people are coming in and taking it. She has lived with me for 19 years and since Christmas she thinks she has just come for a visit, always talking about having to go back home (MO) dreading the trip. She can't hear, I have to repeat everything 4-5 times, then when I raise my voice so she can hear, she says I'm yelling at her. So hard to be patient when she refuses to cooperate with anything I suggest. She won't believe anything I tell her, always has to go check it herself.
A little more detail would help... who is this person POA for, and are they now mentally incompetent? The simplest way to do this is to have the person who granted the POA write a new one and revoke the previous one. If they are unable to do that then it gets more complicated, but if the POA is doing things that are not in the best interest of the person who granted their authority they can be removed... you will need to seek legal advice on the steps necessary to do that. If there is no alternate named, you may need to seek guardianship since by having the original person removed you will be unable to replace them.
