Is using someone's social security checks for everything other than their health benefit legal?

My sister in law claimed she had POA over my dad and even gets his check in a personal account. She doesn't use any of the money for my dad she uses it for herself. I managed to get her POA thrown out but I can't seem to get her to give me my dads money and the state is not helping. What should I do?

No it is not illegal to spend Dad's SS check for things other than his medical care. He could spend it on food or a movie or going to a casino.

But stealing someone else's SS money is definitely a crime. Call the police. Call APS.

Your sister must be the representative payee for the checks to be going to her. If so, surely that can be changed.
