Is there any way to help my aunt? Her 2nd husband is trying to charge her with abandonment, because she can't take care of him any longer.

My aunt is 68, but is disabled from a car accident that happened about 10 years ago. She has to use a walker. Her husband of 20 years has gotten ill, mean and has been hospitalized for the last 4 months. When my aunt told his daughter, she couldn't take care of him any longer, the daughter and her husband are threatening to charge her with abandonment. My aunt claims his daughter has been spending her dad's money like crazy, so she took her half out and put it in an account in just her name. I really don't know the financial situation like who's spending what, but now he and his daughter are furious. They want me to get his money and things from the house, which isn't possible. I have no legal right to any of my aunt's things. I have been doing her errands and shopping, because she can't drive and someone has to help her out. But, I worry they will hire a lawyer and make my aunt look like the villain here, or me. They keep making threats.

Thanks for all the advice, but maybe fixed itself. The DR put her husband on antidepressants. Has made a huge difference in his mood, and just being rational.

By all means, have your aunt talk to Adult Protective Services and an Attorney, but don't take any actions on your own, like going to the house and retrieving things that belong to either party. It doesn't sound like that was your plan anyway, but just putting that out there. Keep this situation at arm's length and help as you can, but don't get too involved - this is a volatile situation that has the potential to become explosive, and you don't want to be in the middle.

I'm so sorry to hear what is happening with your aunt. Please call the Adult Protective Services in your community or consult with the Seniors Department in the town or talk to a social worker about your aunt's situation. Good of you to act as her advocate.

Help your aunt get an attorney. Also have her talk to her own doctor.
