If I have POA on my mom, who gets served any court documents on her behalf?
Step father wants guardianship, I have Durable Power of Attorney, and I'm concerned he will have her served when I'm not there. She has Alzheimer's Disease.
Do the two of you not agree on her care? Is he her caregiver? Guardianships aren't just handed out and I'm pretty sure you and any siblings would be served and could contest his being given guardianship. If there is a problem that you and he can't resolve it might be prudent to see a qualified attorney.
