If mama should hurt someone, am I going to be the one liable for any possible damage?

I am the caregiver for my 87 year old mother, who is definitely showing signs of dementia. Her memory is failing and she is forgetting how to do simple things for herself. Today, she gave the sitter a hard time with her bath and the sitter said mama hit her. The sitter wasn't upset and said that she knows it's mama's mind. If mama should hurt someone, am I going to be the one liable for any possible damage?

You might also contact your homeowner's insurance agent about an umbrella policy. Check that it will cover you in such situations.

First of all, have your mom checked for a urinary tract infection. My mother became combative when she had one. When she smacked a few other residents in her facility, no charges were ever filed against her. The facility handled it. I think professional caregivers take the job knowing they may be working with combative patients. I’m not an attorney, but I would say someone would have to file charges against your mom for assault before anyone would be held liable.
