My mother is 85 yo & was diagnosed with Alzheimer's with moderate dementia. A social worker from ADP recommended a durable POA. Can we at this stage?
I want make sure that seniors like my mom's case can do a durable power of attorney in CA. Because she is not in late stage or advanced Alzheimer's. Please advise me. Thank you Nancy1414
Nancy, if you think your Mother would be able to understand what a Power of Attorney is used for, then I see no problem with her obtaining such a legal document.
I would recommend to take Mom to talk to an "Elder Law Attorney". Also take Mom's Will and any other legal documents for the Attorney to review to make sure such documents are up-to-date with current State Laws.
If you notice that a certain time of day that Mother seems like she is more in the here and now, try to schedule the Attorney appointment for that time. For my own parents, who were in their 90's, I found they were more clear minded in the morning, as in the afternoons they were pretty much napping which is common at their age.
