What is considered as a gift in the 5 year Medicaid look back period in Colorado?

My grandma has been paying for groceries and other personal needs by writing one check to me or my mom. Now we have to put her in long term care and need to get her on Medicaid. When they complete the 5 year look back, will they look at the checks she wrote to me and my mom and call them gifts? What about paying for things like pharmacy charges? What all do they consider? We are trying to keep her house and she doesn't have any other money. Any experience with this is greatly appreciated! Thank you!!

Which is it? Those are very very different paths to take for grannie & your/her family’s finances and for Medicaid rules. Which is it?

Please note that the grandmother's house is only an exempt asset as long as she owns it. If you sell the house, yes, the profit from the sale of the house must go to grandmother's care in the facility before Medicaid will pay. You can't just "repay your money spent" or have grandmother "gift the money to family" from the profits.

I did this and it was never questioned. I bought on credit card what Mom needed and once a month I wrote a check to myself when I paid bills. I did keep receipts. I don't think they scrutinize every check. Buying groceries and prescriptions should not amount to that much. Medicaid looks for large amounts going out of accounts. Don't think you aren't the only family doing it this way. Wait till they ask and then tell them what you did.

We do not have receipts, but she didn't pay for any groceries or prescriptions herself, we used this money to repay buying those things. Is there any type of exception there? If she has a $10,000 penalty because of those checks, and we sell her house, will we have to pay all of the profit from the house to the long term facility before Medicaid will pay?

Do you have receipts? Without documentation - it will likely be seen as "gifting".
