What is my right, living in a senior housing non smoking building and management is protecting a smoker who I have to smell for the last 2 years?

If you really want to push it, I would consider seeing an attorney about writing a letter on your behalf. You could potentially threaten to sue the landlord since second-hand smoke is detrimental to your health. It just depends if you want to go nuclear like that or not.

Or ask management to pay for a Hepa air filter for your apartment, so the smoke is filtered out as much as it can be. I'd be ticked too if I was you! Your downstairs neighbor could go out and smoke away from the apartment or get a nicotine patch or even vape (I think). I'm not a smoker either.

I can sympathize with you but...they gave her 6 months which is probably the law or when her lease is up. They can keep telling her but she was given a timeline. You may just have to deal with it a little longer. Maybe you could get an airfilter till then.

That is totally maddening, Chacha. One thought I'm having, does the lease or no smoking form spell out what happens if a person is caught violating the no smoking rule? It doesn't seem fair to make tenants have to breathe secondhand smoke for 6 months because this person isn't obeying the rule.

This is a new complex we’re everyone living here signed a NO SMOKING form and it is also in the lease. Several times mngment has verified the smoke in my apt and the tennent below. She promised to stop smoking and they are giving her 6 mos. to move and they will help her. This is because of here promise, she has been caught smoking in her apt and I reported on her patio. They have done nothing for the inconvenience I am going thru as a no smoker.

I don't blame you for being annoyed, Chacha. I've visited in senior housing complexes that had a designated smoking section and of course the fumes circulated all through the building. Smoking is also a fire hazard.

ChaCha, we need more background information so that we can give you appropriate suggestions for your situation. Are you the manager of the senior housing building? Or do you live in the senior housing building and the management is allowing someone who also lives in the senior housing building to smoke? When was the building made "No Smoking Housing"? Was the other tenant "Grandfathered in" after a new "No Smoking" policy went into effect?
