If he has assets of $400,000 she should be paying for her own nursing home care. Medicaid was established as a program for the very poor, not as a program for those who have assets. Taxpayers do not want to pay for care for those who have money to pay for care.
We need more info. When you say estate, what for is it in? House, cash, comic books? Is mom still alive? If she is, you can get most if not all of that exempted from medicaid consideration.
Medicare does not go after estates. Medicaid attempts recovery. Unless it’s very specific type of exempt asset, Dad won’t be eligible for Medicaid so no one will attempt recovery. On the other hand if dad needs nursing home care, he will be private pay and it won’t be $400k for long.
