Can I get out of a lease if my father is going to assisted living?

I'm 19 and me and my father signed a lease in May. He's being moved to an assisted living facility because of recent health complications. My name is on the lease and with him gone so is the rent money and it falls on me and I'm all by myself looking for an answer. I don't know where I'll end up so I'm looking for answers.

Most states have laws that allow seniors (62+) moving into a senior community to terminate their lease without penalty. The termination would take effect 30 days after the day upon which the next rental payment is due.

I'm not sure though if that would hold true with your being on the lease as well. Have you contacted your county or city's Senior Services Department? They should be able to answer this question for you.

Good luck

Does does your dad have enough money to pay for both assisted living and the lease on the house? If not, I suggest talking with the person from whom the house was leased.

Even with him in AL you've got to live somewhere - maybe you can find a roommate to share the cost?

Read your lease. There maybe a clause for something like this. Get a Doctors note explaining that Dad needs care that can't be given at home. I assume you can't pay the rent on your own. When I broke a lease, I was penalized two months of rent.

If you are in New York State and your dad is 62 this information starting on Page 14 may apply. I used this when Mom moved from her independent living apartment to. Assisted living to get a months rent returned. (She was month to month however).
