No need to stop by a lawyer. Texas medicaid does not put leins on properties nor they can forclose on them. If mom goes on Medicaid, sometime after her death, the Texas Medicaid asset recovery program will make a claim against her estate. BUT They DO NOT have the power to force repayment. So your trailer is safe. Medicaid won’t take it.
Do you mean that she cosigned as the OWNER or on the LOAN for payment. I would stop by a lawyer. An hour of him time will run you likely over 300.00 but the question could be answered pretty much at once, and you DO need to know. EVEN if she cosigned and is coowner, I do not believe that monies on this trailer can be recovered, even by medicaid, until when and if it is SOLD. And even then would likely be a division of monies, but this is a guess after reading and I am no lawyer, and as to medicaid the laws vary by state. Do check so you can sleep well.
