How do I get rid of my abusive caregiver?

I have a caregiver who has been with me for 3 years. She is abusive and I have considered reporting her to APS for elder abuse. I fired her in July but she refuses to move out of my house even though she is no longer my employee and is trespassing. I have contacted a lawyer who is ready to file an Eviction action against her.

Why haven't you reported her by now? I have read previous posts and you have been dealing with Caregivers since last May.

Your doing what u need to, getting a lawyer. Let him do what needs to be done. I suggest though, once she is served, if she shows any abuse towards u call the Police. Like Techie says, maybe APS can do it faster if your afraid the CG will abuse you.

If you fired her in July, who is helping you now? Is someone around or are you alone in the house? I'm concerned what an abusive person could do when served eviction papers if she is still in the house with you. Is there somewhere you could stay for a few days? Or someone who could join you in your house? APS might be a better choice if they can get her out of the house immediately.

Do you feel you are in danger? If so, let attorney know and then secure a restraining order. That would get her out faster. Otherwise listen to your attorney and eviction in your case must be required by your state law since that is what attorney has told you.

What have you done so far? Maybe she cannot leave you alone? Do you have any family?

What kind of abuse? Physical? Financial? Emotional? Sexual? Are you paying this person or are you exchanging accommodations for the caregiving? I've read on other posts that in some states you don't have to go through eviction if they are professional caregivers, but your attorney will give you guidance. Wishing you a safe and speedy resolution!

Listen to your lawyer, in some states you will have to give 30 day notice to evict.   No reason you should not file police complaint.

Change the locks & put her stuff on curb. Call police & have her escorted out. Tell them it’s your house & she’s abusing you! Get her arrested! Good luck! Hugs 🤗
