My MIL can no longer drive and my husband has been using her car as his daily driver the past few months to keep it from sitting, fluids running through it etc. It's obvious she will soon need to be moved to a NH and apply for Medicaid. I understand she is allowed to keep her car, but could my husband continue to drive it daily? We have an appointment with elder lawyer soon, but wondered if any of you had any insight. He does have Durable POA. Thanks!

Do you want the car? Can you purchase it from her?
buy the car from her...or sell it. Use the proceeds for her care.
this could be a real problems for her and you. Just sell it.

Also, if your parents give you permission to drive it, I'm not sure why it would be a problem. Who is paying for the insurance, repairs + maintenance?
