If you request a medical evaluation when someone is confirmed confused, but the facility fails to carry it out is it non compliance?
Requested a medical evaluation after a second fall, where confusion was announced numerous times by the facility, does this equate to non compliance if you are the acting POA of health??
If you wish your elder to receive a medical evaluation then make an appointment. YOU are the POA, not the facility. Facilities have their own rules and assessments. If a fall involves injury to skin integrity or to the head there is almost always an ambulance called to transport an elder to an ER. That of course is a bit dangerous in Covid-19 times. Please ask your facility, as the POA, what the protocol is at their facility. I did that and was told exactly what the protocols are. If there is new confusion then a UTI could be involved. Again, you are the POA. If you feel that an MD should be consulted it is on YOU to order that. UNLESS of course you are speaking of a rehab or SNF where an MD is in charge of your mother's care. Then you should call social services to be certain that the MD will see your elder, report your own perception and suggest that "something" seems to be changing, ask if a uti could be involved and etc.

When you requested the medical evaluation, what did whoever you spoke to say?
Does the person's contract with the facility include medical care, provided by a primary care practitioner retained by the facility? Or do residents receive medical attention from their own doctors, individually?
It certainly constitutes non-compliance with your request, but where does that get you?
If you are the person's MPOA, I think it might be up to you to organise the medical evaluation that you have in mind. To whom did you make the request?
Sorry yes we were POA trying to find the right medical facility . We requested the facility to arrange a evaluation to equip us to find her the correct care which would help with declining kidney disease, provide a diabetic diet because of high blood sugar levels and their confirmation-of memory impairment.
