Michael died in 2019. He was never in a care facility. Can I sell our, my home?
We bought it free and clear. Owned it 2 years when he died. He was in this state for 4 years and got his disability here. Can estate recovery really want repayment? It seems like a mistake. We were tenents in common. Michael died suddenly.
Was he on Medicaid at all? Thats the only time the State tries to recoup. Was his Disability Social Security if so there is no recouping on SSD. No recouping if he got State disability.
This is best left to a real estate attorney. Unless he left his half of the house to you, his next-of-kin owns his half of the house. (I'm assuming you weren't married, because you'd have held it as Joint Tenants with Right of Survivorship.)
I'm not an attorney, but I'd say your half of the money is yours because it isn't part of his estate. However, you can't just up and sell the house without the other party (if there is one) being involved.
