How can I legally force my sister to let me get updates on my mom?

JoAnn29 Nov 2021
If Sis is the POA then she represents Mom. As such, she is not obligated to give information to anyone else. Just like Mom is not obligated to give out any info.

POA, unless immediate, is not in effect unless Mom has been found incompetent. If Mom is competent she can have you put on HIPPA paperwork. She can talk to you herself.

I felt that my brothers should have info. My Mom was very open about her health and finances. Some parents aren't but since Mom was I had no problem telling my brothers how she was. Both trusted me concerning money and never felt they would inherit anything. I didn't call them every time she fell and went to the hospital. They pretty much left everything up to me.

You cannot force your sister to do anything. You have no right to information unless you are the POA. If your sister is in charge of care, or the POA, then she must obey the rights to privacy of your Mom as though she were your Mom herself. You should now be offering help to your sister, who clearly stands as the Lioness at the Gate. Let her know you are ready to help and assist to the best of your ability. I am afraid it sounds as though you have entered the sticky land of bees who respond only to honey. Best of luck negotiating a good relationship that will be productive for all.

You can't. Probably. Depending.

By "updates" you mean what sort of information, exactly? Bear in mind that much of the sort of thing that people generally want to know about is governed by codes of confidentiality, including medical and financial information. You don't automatically have any right to it.

Would you like to say a little more about the situation so that we can understand why you need to go through your sister to keep in touch with your mother and be informed about her wellbeing?
