Unless some attorney offers to take this on for a share of any "wrongful death" do not do it. There are always lawyers who will take your case for $5K, but that's just for writing a letter. This escalates to actual litigation, it's more like $15K.

The proceeds minus lawyer would be just yours if you're the only one named in the suit--but then again your chances are not high.

Here is what I think. If you file a wrongful death suit with an attorney, which will be 100 percent needed for this, you would be filing with a statement saying something like you lost the companionship of your mom. It would be personally for you. Anything you get after the lawyer gets his would be yours, tax free I believe. However, very hard to prove what you are saying in these particular circumstances. Grief is a strange thing. There are stages of grief. When a parent gets sick and dies and it is relatively unexpected, or maybe the doctors or family misled a person on the prognosis, the first feeling is to sue. You want revenge. After time goes by things change. Not knowing the details of what happened in your case I am just making a general statement based on experience and observations in life. As far as the rest of the Estate goes, if there is any, that goes by the will. If there is no will you might get the estate if your brothers do not come forward and make a claim.

You say that there is wrongful death money? Could you explain. It is very unusual to win a lawsuit such as this, or even a settlement.
However, let us assume that the lawsuit was filed and won. Who filed the lawsuit and on whose behalf was it filed? What was the settlement? The law will decide and the law will designate how the funds are divided.

From your profile, it's hard to understand why you took your abusive mother in and then cared for her for 2 years. Why did you?

I think it might be too late for you to "get paid" for caring for your mom. I imagine that any money would be given equally to her rightful heirs. Sorry.

Wrongful death generally refers to suits for legal action against party/parties who caused (or possibly contributed) to a death. You refer to money from "wrongful death" - is there a suit in process? If not, what does your use of "wrongful death money" mean?
