You need to go to the labor board and find out your responsibilites as an employer because that is what you will be. IRS looks at CNAs as employees not self-employed so you will be responsible for payroll deductions and seeing that those deductions go to the correct departments. They can only work 40 hrs a week and OT is time and a half. So when they aren't working you need to do the caring or hire someone. Also, room and board is a perk. You cannot charge rent. If they drive its the clients vehicle with the client paying for the gas and upkeep. If their own car is used, then its so much a mile you pay them. They must be paid at least minimum wage and in my State thats $12 an hr. An an experienced RN, your talking $40 an hour at least with an Assoc degree.
If you are still having problems after 3 years, maybe its time to find a place for your LO. If they have no money, apply for Medicaid.
