A newly drawn POA conferred by a COMPETENT person overrides all others. HOWEVER do know that the new POA is responsible now to go to all entities who had the OLD POA. The reason this must be done is that all banks, stock companies, nursings homes, utitlity companies, tax entities cannot know that a new POA was done. Their only way of getting this information is thought the new POA and the person who created a new document. The NEW POA should now go to each bank, each utility, each entity to let them know that a new POA is in effect, and to present papers documenting same.
Yes it should I think regardless of where you live. If you are doing it with a lawyer which I advise then you should find answers from that source. The lawyer will need to feel that the person the POA is being obtained for is in their right mind.
