You need to contact your Labor Board to see what the law is concerning live-ins. There is a thread now where the Live-in is asking if she is entitled to days off.
This topic has been discussed before. Basically, a live-in works the same hrs any enployee works, 40 hrs a week and in my State time and half for overtime. They are entitled to time off where either the family does the care or hire another aide. Room and board are perks. Live-in Aides should be paid at minimum wage at least. Also, as the employer, you must be taking out payroll deductions and seeing they get to the appropriate agencies. Like said, maybe better placing the LO.
Marmie728, with a live-in caregiver, you would need to check with State laws as to how many hours one can work during the day. Plus the caregiver would need to have set days off. Who would fill in on those days?
A live-in would burn out quickly if she is required to be a caregiver from morning into late at night, and be on-call during the night, you'd back to square one. That's why senior living and hospitals have "shifts".
Room and board is a "perk" or "benefit", it is not part of the income. One cannot pay for their own personal items, their health insurance, auto costs, clothes, future savings, and other things needed via a perk.
That is against the law! Slavery was abolished long, long ago. If caregiver contacted the department of labor, you.would have a legal problem. A huge legal problem!
