Does the nursing facility have a right to force patient funds management?

This is if the person is on MedicWhen my Mom entered her NH, I allowed them to be payee for Moms SS and her small pension. From her SS, the NH took $50a month and placed it in a Personal Needs Acct in Moms name that the NH oversees. This fund can be used by the resident or an authorized family member. The family member just needs to bring a receipt for the item bought for the resident to get a refund.

Some family members chose to handle the parent's or LOs money. Deducting the $50 (whatever ur State allows) and keeping track of it, Me, I was happy to allow the NH to be payee. One less thing for me to worry about. When my Mom passed, I presented the NH with her death certificate and Probate's short certificate and received what was in the PNA 2 wks later. This money and any asset money left from the spenddown become part of the persons estate.

Now, if Resident is private pay, I would not turn over the ability to the Nursing home to get into those accts. As long as payment is received on time, there should be no problem.

Are you talking about allowing the NH to administer the patient's Personal Needs Allowance when on Medicaid?

No, but they do have the right to deny services to those who don't pay in a timely manner.
