Selling a house while on Medicaid to move to another state.

Hi, my self and my husband live in NY and we both are retired and have Medicaid, we really want to sell our house and move to Florida closer to our son and because weather helps our health but I was told if I sell the house I will loose Medicaid, what are my options? Please help.

Which Medicaid program are you on?
This is what you need to know exactly as it determines what it was that enabled you & hubs to enroll in NY Medicaid. Like ACA is a different type of Medicaid program as health insurance than being aged / disabled/ lower income as that a different type of Medicaid coverage.
& You can sell you home… there is no way Medicaid can stop that from happening…. It’s your home, you own it legally. & those friends of yours are fear factoring 2 you.

When you move to a new State, you will file for Medicaid in the new State if FL too has the same type of program. And they will have something similar. Each State administers its Medicaid programs uniquely but under overall federal guidelines. There will be something you “fit” into. It may end up being a PACE program as FL is really pushing their Medicaid $ to supporting those in larger cities.

Selling a home, shouldn’t be a factor as that’s an asset, not “income”. “Assets” & “income” in my experience kinda only matter if either of you are currently in or are about to file to be in a NH, as that Medicaid program (LTC Medicaid) looks at both of those 2 categories. If that’s you or your hubs, that a whole other very involved situation & you need to find an atty in NYS asap to speak with. But that not your situation now is it!

Really, I’d suggest that you ask your son to find a couple of of CELA level type of Elder law atty in or nearby his city in Florida to contact and on your next visit down, the 3 of you go and meet with 1 of them to go over all this (with you & hubs and your son). So that once you move, the FL atty can draw up fresh documents so that everything is set up to be all OK for FL and for how FL looks at LTC Medicaid applications should that be needing eventually. It will be ok!

I think I would consult eldercare lawyers both in New York and in Florida.

I agree you need to consult with Medicaid planner and also one in Florida
It might be that for a brief time you are without Medicaid until you purchase another home. (one that puts your assets within the limits set.

Many variables involved, base line answer would be yes, however I would consult an estate attorney before I did anything.

If you sell, you will have money and should be self pay like the rest of us taxpayers.

You really need to consult a lawyer or Medicaid planner to do this. It matters whether you are talking about Community Medicaid or LTC Medicaid.
