I think this would need to be an exception. This person seems to have no one and is over 100. Where is she going to go? How long has she been in the AL? In my State, if paying at least privately for two years, Medicaid can be applied for if AL allows it and hasn't met their quota. My state has a 2k asset cap and a 2300 income cap. Looks like NC has a Miller trust. I would consult with an elder lawyer.
All she would need to do is spend down to the $2,000 asset limit by paying for the assisted living facility. We applied for Medicaid for my brother in law when he was still self-paying for his nursing home. He was over the asset limit at the time his application was reviewed, but after he'd paid for another month of the NH he was below the asset limit. In our cover letter with the application we made note of the fact that he wold be below the limit shortly. We just had to submit an updated bank statement showing he had spent down the requisite amount and he was then approved.
Yes. In NC in 2024, the asset limit for single person is $2000. If she has between $2000 and $4999 in assets she won’t qualify. The monthly income limit is $1616 or $19,392. Find a lawyer who is expert in Medicaid in your state to see if there are any options for spenddown. Also make sure there are available Medicaid beds in facility. She also has to medically qualify.
