My aunt was in the hospital and when they released they took her to a nursing home just because I didn't have any oxygen here for her she was only in there for one night it wasn't even 24 hour stay but the nursing home kept all of her medicine and her scripts that the hospital wrote her that wasn't even filled can they do that in McDowell county wv

A nursing home will not EVER leave medications with a patient. Or not to my knowledge. First of all they must be certain that the patient is able to administer them to themselves safely as they are responsible for mistakes in medication. Secondly, medications floating about in a nursing home poses a danger to others.

You can ask they be returned to you.
The nursing home will be giving medications now according to the MD order for those meds.

If you are POA you can demand that the medications be given to YOU if they are giving meds through a private company that prepackages them and etc. And can ask that the prescriptions be given to you. Especially important in the case of pain medications.

I'm guessing they can do exactly that as they have to do what is in the best interest of your aunt and her health.
And the fact that she's apparently on oxygen and you didn't have any for her at your house(which I presume she was staying at)would most certainly be a BIG red flag to the hospital.
I can't help but wonder why you'd be so concerned about the nursing home having your aunts medications and scripts. Of course they would need all of them to better care for her.
Hopefully your aunt is now receiving the care she now requires.
