my dad is now going through divorce by his second wife, but a 40 years but it’s being pushed on by her daughters after my dad had a stroke. husxwife abandoned him and left to come to New York after he has a stroke. they lived in Arizona for 24 years. the judge is not boating their prenuptial or the law that you have to live in NYS for 2 years to have a divorce. she was manipulating him and begging him to come to New York State and sell everything. He was very sick once he finally got to New York. She slapped a divorce on him. he has Alzheimer’s suffered a stroke he’s living in assisted living, which takes all of his income. They’re insisting on spousal maintenance, which he cannot pay , he is in poverty and i applied for medicaid and now they’re trying to go after me saying that I am power of attorney that I am withholding funds, or have taken funds, but I have not acted or invoke my power of attorney. He has not been determined by a doctor yet ans incapacitated. his will attorney told me I don’t ever have to envoke it. He still manages his own funds. He refuses to pay her because he doesn’t have the money. they just filed a motion on her side asking to hold me in contempt of court if I am not the POA, i haven’t done anything but him give me money to pay bills while he was some in the hospital but that was temporary. I have not filled out any paperwork with a financial institution at all. How can this hold any water in court.
If my dad refuses to pay, that’s on him not me just cause I am named in his will as POA, can they put him in jail at age 82 because he said put me in jail I’m not paying her and it’s no different than then this crap hole anyway. is it illegal for me to help him pay his bills by putting money in my checking account and writing checks to his prescriptions and catheter and co-pays and to his energy bills is that illegal? Can the courts be conducting elderly abuse by the attorneys with excessive legal fees with this court case that’s been going on for four years were they think imaginary money exist that doesn’t exist because accounts were closed they look like they’re still open but they’re not open. I don’t understand how Attorney can ask his client to take out loans to pay him when there’s no money when both people are in poverty can that happen ? what do I do? i think the children are stealing her money they stole from him how do I turn this around.

If your father has hired this attorney, then of course the attorney expects him to pay the bills. If the attorney isn’t helping, then F should terminate his engagement. If F tells the attorney that he is going to be bankrupt, the attorney’s interest will come to a sudden halt. You need to sort out F’s finances. If he really has no money, and that is made clear, everyone else will also lose interest. It may help is he files for bankruptcy. If you have indeed taken F’s money, you need to get yourself out of the problem ASAP, or they will chase you instead of F.
