My brother achieved getting his name on my dad's accounts. Dad understood that naming him executor and POD he could pile everything up in the middle of the room and divide it up between us two. Dad died suddenly and we found out that he named a third son in the will and so the POD took all monies and denied they existed to us until now when he discloses he was a sole beneficiary of over 500K.

It's too bad that your dad did not talk to an estate attorney when planning this. A POD receives the money without going through probate. The point of probate is to have the courts oversee the process of the will being followed. By having a POD for the liquid asset, that transfers outside of the will. I don't see there being recovery. I'd talk to an attorney, but that's my understanding, and why probate is not such a bad thing if there is more than one kid.
