As an only unmarried caregiver for my mother, I am frustrated because she wants to live with me, this I also want but private guardian says no. Mom is in a memory care facility that most residents are in a different level, I've moved to an assisted living facility to be with her, yet the court appointed guardian says no! Because it will confuse her. Yet me and mom talk every hour of every day and she only wants to be with me. Don't know how to fight to get her with me.

It's says much to me that your mother is in memory care with a guardian and that you moved into AL. I have a feeling that the guardian is making a wise call and that you should continue with your own life, visiting with your mother at her home. Her guardian was right that it could cause a lot of disruption to move her, then later move her again. If your mother is in memory care, it may be too much for you to handle alone. Be thankful she is in a place that is able to provide for her needs.

Your only option is to demonstrate to the Guardian that this would be better for her than her present situation, and honestly I doubt that you can. If you are talking to her "every hour of the day" I think you are preventing both of you from finding friends and activities apart from each other, in the long run this isn't good for either of you.

I agree with what cwillie said. However, if you really want to go down that road I'm afraid you're going to need a lawyer and a lot of money.
