My mother passed away. She passed away without a will or life insurance. My cousin and I paid for expenses, none of my siblings offered anything or helped on the payment plan of the costs. After her passing, right away I knew something was wrong with the story of how she passed- everyone did- so I hired a lawyer and come to find out there was wrong doing. Everyone aware of lawyer and lawsuit know that it's time for settlement. Siblings want it all, and say I should not get paid back for funeral expenses from my savings and also had to pay on payment plan. Is it wrong of me to get paid back?
Seriously--and of course they'll want their cut of the lawsuit, right? Well, give it to them, minus their "share" of funeral expenses. Let them howl.
But, out of curiosity- what reasons do your siblings give for you to not receive reimbursement? Did you have any monies owed to your mother - say, like paying back a loan mom made to you?
Cause barring any reason such as mentioned above - this just is one nutty “request” being made by your siblings.
A probate judge will order that any outstanding debts be paid off the top - prior to any division of assets to heirs.
You need to get your receipts in order or whatever documentation you may have concerning what you paid for funeral expenses. Have your attorney help submitt them to the probate court for your reimbursement. Screw your siblings. Sheez!
