When do you invoke a POA?

What does your PoA document say? Sometimes people put in that 2 medical diagnoses are needed. Hopefully you Father requires only 1.

You will need to have his physician put this in letter form on his clinic's official letterhead and then print it out. You will need to show it to banks and other financial institutions if you wish to now manage his affairs as his active PoA.

I just did this for my Mom. I had been operating, with her permission, as her Durable PoA. Now she has advancing dementia and memory issues and has poor judgment and executive skills so I am managing almost everything for her daily.

I needed this letter plus signed affadavits to manage her investments. Other medical clinics may require it. His bank will have a rigorous protocol as well. Having the letter means you now won't need to bring your Father with you to accomplish certain tasks.

Be sure to review the entire PoA document so that you know exactly what authorities you have on his behalf.

The person has to relinquish the right for you to become POA. If not you my have to got o court to become guardian. As stated in an earlier post check the terms of POA in your dads paperwork.

A POA is selected by a person to act in their best interests in a time when he/she can no longer do so for themselves. According to your father’s doctor that time has arrived for him. Either you need to begin acting as POA, after reviewing the terms of the document, or seek to resign if you don’t feel you can do it. The task will need to be assigned to someone else

It depends what is written on your POA, some have stipulations about conditions required to invoke them and others are in force the moment the ink has dried.
