My dad passed on 2/2 his checks were direct deposit. So far no deposit has come, I did notify SSI right away with his death certificate. If one does come, can my mom keep it? Or just leave for them to retract it?

She should have received the January Money with a February check. You may want to call SS they have made mistakes in this area. And the person still getting checks, better not spend because they will ask for them back.

Well I was under the assumption since he passed 2/2 she would of received his January check, but she did not. Funny because a friend of mine his other passed and he has received 3 checks so far and they notified SSI way back. Got to love our system!

SS works just like a job. The January check is actually the December monies. If Dad died in Dec then he is not entitled to the January check. If he dies January then he doesn't get Feb. I cannot believe you need to wait till April to straighten out Moms SS. I think you can do it online. And yes, Mom will get the higher amount. Wonder if she will be entitled to retro payment since it is taking so long.

Ejeff is correct - when 2 married people are on SS and one of them dies, the surviving spouse is allowed to keep the larger of the two incomes - so when my Dad died, Mom's SS went away and she started receiving the amount Dad had been getting.

Keep in mind, even though they get to keep the larger of the 2 incomes, they're STILL losing one income, and if their lifestyle and bills were based on those 2 incomes, there's going to be some tough times ahead. Someone will need to step in and help.

yeah I don't think his January check is coming as its usually here, I did go to SSI and report his passing as did the funeral home. They have a phone interview set up for my mom in April that was that is the earliest they had. This way she'll be able to get his benefits from what I am told after as he made more then her.

Ejeff, if Social Security decides your Dad was not entitled to that amount due to the date of his passing, SS will automatically retract it. SS usually grabs it pretty quickly.
