My fathers assets are running out. He still has his home, but is living in an assisted living facility. He also owns some commercial property that we’ve been actively trying to sell for the past 5 or so years. What are some of our options? He doesn’t qualify for Veteran help due to the time he served! His only income is his Social Security each month that only pays a portion of his monthly rent. Help! Looking for advice!

Hi Rose, just based on what you've written here, my understanding is that your father's house needs to be sold and any proceeds are to be used for his care, and also the commercial property needs to be sold if it's in his name only. Having a consultation with an Elder Law attorney would be well worth the money here, to get expert advice on how to proceed.

Edit: I know that Medicaid allows for people to keep their houses, and the state may/will file lien after the person has died. In this case, since the father isn't living in the home, would Medicaid still allow it to be kept while the father is alive? This is something I don't know, but maybe another user here will know, and this is something you'd want to ask an attorney.

Next would be to sell his home. Is it sitting empty? I don't have any idea what Medicaid would do about commercial properties he owns. Can they be rented out to provide income for care?

See an elder law attorney to assist. The commercial properties will need to be specially dealt with.

Medicaid does allow one home to be kept. They understand the potential for the rental home to provide income. How that would effect Medicaid Estate Recovery, I have no idea. It seems it would only reduce the need for Medicaid funds and there would still be a lien placed for what rent of the home would not cover.
